TERMS OF SERVICE & USER AGREEMENT

IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THEDEVSUPPLY, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

1. NATURE OF SERVICE (SAFE HARBOR DISCLAIMER)

TheDevSupply acts exclusively as a data indexing service and search engine.

We do not host, store, or upload any files to our own servers.
All content found on this site consists of links to third-party file hosting services (e.g., Rapidgator, etc.) or are provided via third-party APIs.
We have no control over the content, copyright status, or availability of files on external servers. We act in good faith as a service provider under the principles of “Safe Harbor” provisions.
Your subscription fee is for premium access to our indexing platform, API speeds, and curation services, not for the purchase of the digital assets themselves.

2. FILE AVAILABILITY & THIRD-PARTY HOSTS

While our system performs regular scans to verify link health:

We cannot guarantee 100% uptime or availability of any specific file.
We are not responsible if a third-party file host (e.g., Rapidgator) deletes a file, experiences downtime, or if a link becomes “dead.”
Such occurrences are outside our control and do not constitute a breach of service on our part.

3. ACCOUNT SECURITY & SHARING

Your account is for your personal use only.
Sharing your login credentials with others is strictly prohibited.
We employ automated IP tracking and behavioral analysis.
- Simultaneous logins from different geographic locations will trigger an automatic security flag.
- Violations will result in immediate account suspension without refund.

4. ANTI-SCRAPING & FAIR USE POLICY

To protect the integrity of our service for all users, we enforce strict anti-abuse measures:

The use of scripts, bots, spiders, crawlers, or any automated method to download files is strictly prohibited.
“Hoarding” or high-velocity downloading (downloading a significant portion of the library in a short timeframe) is a violation of these terms.
Any account detected using automation or bypassing our rate limits will be permanently banned immediately.
Accounts banned for abuse are not eligible for refunds under any circumstances.

5. REFUND POLICY

Because we offer immediate access to digital services, all sales are generally final. Exceptions are made only under the following conditions:

If a technical failure on our end (e.g., our API is down, or our platform fails to generate a link to an active file) prevents you from using the service.
You must report the technical error to our support team within 24 hours of the occurrence.
Refunds are NOT granted for:
- Slow internet speeds on the user’s end.
- A specific third-party file being unavailable (dead link) while the service itself is functional.
- Change of mind.

EU Right of Withdrawal (Sweden/EU Users):
By clicking “Subscribe” or “Download,” you expressly consent to the immediate performance of this contract and acknowledge that you thereby lose your right of withdrawal (the 14-day cooling-off period) once the digital service has started.

6. CRYPTOCURRENCY PAYMENTS

All cryptocurrency transactions are final and irreversible.
It is the user’s responsibility to account for network/gas fees. If you send an amount lower than the invoice price, the system will not activate your account.
Due to network fees and processing costs, partial payments (underpayments) are non-refundable.

7. LIMITATION OF LIABILITY (“AS IS”)

All indexed files are provided “AS IS” and “WITH ALL FAULTS.”
We make no warranty regarding the safety, functionality, or compatibility of the files indexed.
TheDevSupply is not liable for any damage to your computer, software, or project data resulting from downloaded files. You download and use files entirely at your own risk.

8. COPYRIGHT INFRINGEMENT & TAKEDOWN PROCEDURES (DSA COMPLIANCE)

We respect the intellectual property rights of others and comply with the Swedish Copyright Act and the EU Digital Services Act (DSA).

If you are a copyright owner (or authorized agent) and believe that any content indexed on our platform infringes upon your copyrights, you may submit a notification pursuant to the DSA.

Notices must be submitted via the form on thedevsupply.com/dmca

Upon receipt of a valid notice, we will expeditiously remove or disable access to the specific link in our index. We also terminate accounts of repeat infringers in appropriate circumstances.

8. GOVERNING LAW

These Terms shall be governed by and defined following the laws of Sweden. Any dispute arising in relation to these terms shall be subject to the non-exclusive jurisdiction of the courts in Sweden.
